Welcome to Dalalmaf ("Dalalmaf", "we", "our", "us"). These Terms and Conditions ("Terms") govern your access to and use of the Dalalmaf website, mobile website, apps, and related services (collectively, the "Platform"). By using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1) About Dalalmaf (Platform Role)

Dalalmaf is an online platform that helps users to post and discover real estate, services related to property and accommodation listings, including buy/sell/rent/lease/PG etc. ("Listings").
Dalalmaf is not a real estate broker/agent and does not guarantee any transaction, buyer/tenant, seller/owner, rent/price, property condition, title, approvals, or legality of any property. Users are requested to check legality, technicality of property and buyer/seller's genuineness before presiding further for any services available on Dalalmaf.
Any dealing, site visit, negotiation, agreement, payment, and transfer is strictly between users. Users must do their own due diligence.

2) Eligibility and User Account

You must be at least 18 years old and legally able to enter a contract to use the Platform.
If you create an account, you agree to provide accurate information and keep your login details secure.
You are responsible for all activity from your account. Notify us if you suspect unauthorized use.

3) User Content and Listing Rules

"User Content" includes your listing details, description, photos, videos, documents, and any information you submit on Dalalmaf.

By posting a Listing, you confirm that:

You have the legal right/authority to advertise the property (as owner or authorized representative/agent).
All information is accurate and not misleading, including location, price/rent, availability, area, amenities, and photos/videos.
Your content does not violate any law or any third-party rights (copyright, privacy, trademark, etc.).
You will not post: fake, duplicate, irrelevant, or misleading listings; incorrect contact details; content that is abusive, discriminatory, obscene, or illegal; personal sensitive information publicly (e.g., Aadhaar/Passport numbers, bank details).
If any legal issue or other regulatory body arose due to post then user will be responsible for it as well as all legal penalty or punishment.

Dalalmaf may edit, reject, disable, or remove any Listing/User Content at any time, with or without notice, to maintain quality, prevent fraud, or enforce these Terms.

4) License to Use and Promote Your Content (Including Social Media Uploads)

When you upload or submit User Content on Dalalmaf, you grant Dalalmaf a non-exclusive, worldwide, royalty-free, fully paid, transferable, sublicensable license to: host, store, reproduce, modify (format/resize), translate, display, publish, distribute, and publicly perform your User Content; use your User Content to market and promote your listing and the Platform, including by sharing or uploading your property photos/videos/details on Dalalmaf's official channels and third party platforms such as YouTube, Instagram, Facebook, and other social media/advertising platforms; and create promotional materials (for example, short videos, posters, reels, thumbnails, collages) using your content, while keeping the listing meaning intact.
This license is granted for the duration your Listing is active and for a reasonable time afterward for backup, legal compliance, dispute resolution, fraud prevention, and marketing records.
You confirm you have all required rights and permissions from owners, tenants, society, or any other person to allow Dalalmaf to use and publish the content as described.
If you want your Listing removed or do not want promotion on third-party platforms, you can request it at info@dalalmaf.com. Removal from third-party platforms may take time and may not be instant due to the policies and processing of those platforms.

5) No Verification; User Due Diligence

Dalalmaf does not verify: property ownership/Title; agent authorization; property approvals/permits; accuracy of listing claims (area, amenities, distances, etc.); Construction quality of property.
You are responsible to verify all documents and facts before paying any amount or signing any agreement.
Safety tip: Never send money without meeting/verification and proper documentation.

6) Communications and Leads

Dalalmaf may provide contact buttons, chat, call, email, or inquiry forms. By using these, you agree that your contact details may be shared with other users to enable communication.
Dalalmaf is not responsible for user interactions, statements, conduct, or outcomes of any discussions or meetings.

7) Prohibited Activities

You agree not to:

post fraudulent, misleading, illegal, or stolen content;
harass, threaten, defame, or discriminate against others;
spam users or send unsolicited commercial messages;
scrape, copy, data-mine, or use bots to collect data from the Platform without written permission;
attempt to hack, damage, or interfere with the Platform;
impersonate any person/entity or misrepresent your identity or relationship to a property.

8) Paid Services

Dalalmaf may offer paid plans (e.g., premium listings, boosts, advertisements). Prices and features will be shown on the Platform.
Unless required by law or stated otherwise, fees are non-refundable once the service starts.
Paid services do not guarantee a sale/rent/lease, lead volume, or response rate.

9) Intellectual Property (Dalalmaf Rights)

Dalalmaf's name, logo, design, software, and Platform content (excluding User Content) are owned by Dalalmaf or its licensors.
You may not copy, modify, distribute, or create derivative works from the Platform without written permission.

10) Third-Party Platforms and Links

Dalalmaf may share/upload listings or run promotions on third-party platforms (YouTube/Instagram/Facebook, etc.). Those platforms have their own terms and policies.
Dalalmaf is not responsible for third-party platform actions, downtime, moderation, or policy enforcement.

11) Privacy

Your use of the Platform is also governed by our Privacy Policy. Please read it to understand how we collect and use data.

12) Disclaimer

The Platform is provided on an "as is" and "as available" basis.
Dalalmaf does not make warranties about accuracy, reliability, availability, or suitability of Listings or Platform services.
Dalalmaf does not guarantee that the Platform will be uninterrupted or error-free.

13) Limitation of Liability

To the maximum extent permitted by law:

Dalalmaf will not be liable for indirect, incidental, special, consequential, or punitive damages.
Dalalmaf is not liable for losses arising from: fraud or misrepresentation by users; property disputes, title issues, or quality/condition; failed transactions, cancellations, or payment disputes between users; reliance on listing content.
If any liability is imposed, Dalalmaf's total liability will not exceed the amount paid by you to Dalalmaf (if any) in the last 3 months, or INR 3000, whichever is lower.

14) Indemnity

You agree to indemnify and hold harmless Dalalmaf and its team from claims, damages, losses, and expenses (including legal fees) arising from: your Listings/User Content; your violation of these Terms or law; your dealings with other users; your infringement of third-party rights (copyright/privacy/trademark).

15) Suspension/Termination and Removal

Dalalmaf may suspend or terminate your account and remove Listings/User Content if you violate these Terms, create risk, or engage in suspicious activity.
You may stop using Dalalmaf at any time.

16) Changes to Terms

We may update these Terms from time to time. The updated version will be posted with a new "Last Updated" date. Continued use means you accept the updated Terms.

17) Governing Law and Jurisdiction

These Terms are governed by the laws of Gujarat (India). Courts at Surat city will have jurisdiction, unless applicable law requires otherwise.
