Terms of Use

These Terms of Use ("Terms") are an agreement between you and Dalalmaf, of Surat, Gujarat ("Dalalmaf", "we", "us"). They apply whenever you use https://dalalmaf.com. By creating an account or using Dalalmaf, you agree to these Terms, our Privacy Policy (https://dalalmaf.com/legal/privacy) and our Listing Policy (https://dalalmaf.com/legal/listing-policy). If you don't agree, please don't use Dalalmaf.

1. About Dalalmaf

Dalalmaf is an online listing platform. It lets property owners advertise their properties for sale, rent, lease or PG accommodation, and lets people looking for property contact owners directly.

• Dalalmaf is not a real-estate broker or agent. We don't take part in, negotiate or guarantee any deal between users, and we don't charge brokerage.
• We don't give legal, financial, tax or property valuation advice.
• Under the Information Technology Act, 2000, Dalalmaf is an intermediary. Listings and messages are written by users, who are responsible for them.

2. Who can use Dalalmaf

You must be at least 18 years old and able to enter into a binding contract under Indian law. If you use Dalalmaf on behalf of a business, you confirm that you're authorised to bind it to these Terms.

3. Your account

• You sign in with your mobile number, verified by a one-time code (OTP). You may also set a password.
• Give us accurate information, and keep it up to date.
• Keep your sign-in codes and password private, and never share an OTP with anyone. Dalalmaf staff will never ask for it.
• You are responsible for everything done through your account. Tell us immediately if you think someone else has used it.
• One person may hold one account. We may limit how many listings an account can post.

4. Posting a property

When you post a listing, you confirm that:

• you own the property, or are legally authorised by its owner to advertise it;
• the details, price, photos and videos are true, current and of that property;
• the property is legally available for the purpose you list it for;
• you will follow our Listing Policy (https://dalalmaf.com/legal/listing-policy).

Our team reviews listings before they go live. We may ask for changes, refuse a listing, or remove it at any time if we believe it breaks these Terms, the Listing Policy or the law. Listings expire after a set period unless you renew them.

5. Contacting owners

• When you send an enquiry, your name and mobile number are shared with the owner of that listing, so that they can reply to you.
• Use owners' contact details only to discuss that property. Don't use them for marketing, spam or anything else.
• Owners must not misuse the details of people who contact them.

6. Auction Properties

The Auction Properties section shows properties that banks and financial institutions are selling by auction. Those listings are posted by verified bank staff.

• The auction itself is run by the bank, under its own auction notice and terms. Dalalmaf is not a party to it and doesn't run, guarantee or take part in any auction.
• Always read the bank's official sale notice, and confirm every detail, including reserve price, EMD, dates, dues and possession, directly with the bank before you bid or pay anything.
• Bankers must post only properties their bank is actually auctioning, with accurate details and documents.

7. Your content and the licence you give us

You keep ownership of the photos, videos, text and other content you post ("your content"). You confirm that you own it or have permission to share it, and that it doesn't infringe anyone's rights.

You give Dalalmaf a worldwide, non-exclusive, royalty-free licence to host, store, copy, adapt (for example, resize, crop or add our logo), display and publish your content in order to run Dalalmaf and promote your listing. This includes promoting it on Dalalmaf's social media channels, such as YouTube, Instagram, Facebook and Threads. The licence for using your content on Dalalmaf ends when you remove the listing or delete your account. Copies already published on social media, or in backups, may remain for a reasonable time.

8. Videos on YouTube

Dalalmaf uses YouTube API Services to publish listing videos on Dalalmaf's YouTube channel. By uploading a video to Dalalmaf, you agree to be bound by the YouTube Terms of Service: https://www.youtube.com/t/terms. Google handles videos on YouTube under the Google Privacy Policy: https://www.google.com/policies/privacy

A video stays on Dalalmaf's channel after the listing is sold or removed. If you want your video taken down, contact our Grievance Officer and we will remove it within 30 days.

9. What you must not do

You must not:

• post false, misleading, duplicate or fraudulent listings, or listings for property you aren't entitled to advertise;
• put phone numbers, email addresses, website links or other contact details in a listing's title, description, photos or videos;
• post content that is unlawful, obscene, defamatory, hateful or discriminatory, or that infringes someone's intellectual property or privacy;
• discriminate against anyone on the basis of religion, caste, community, gender, marital status, food habits or similar grounds;
• ask for money, a token amount or a deposit from someone before they have seen the property and its documents, or carry out any scam;
• harass, threaten or spam other users;
• copy, scrape or collect listings or users' data by automated means, or use Dalalmaf to build a competing database;
• try to get around our security, overload our systems, or access accounts or data that aren't yours;
• impersonate any person or organisation, including Dalalmaf or a bank;
• use Dalalmaf for anything illegal.

10. Fees

Posting a listing and contacting owners on Dalalmaf is currently free, and Dalalmaf charges no brokerage. If we introduce paid features, we will tell you the price and terms before you buy anything. You will never be charged without agreeing to it first.

11. Disclaimers

Listings are created by users. Dalalmaf doesn't verify ownership, title, approvals, price or availability, and doesn't guarantee that any listing is accurate, complete or lawful. Before paying any money or signing anything, verify the property, its documents and the other person yourself. Dalalmaf is provided "as is" and "as available". We work to keep it running and secure, but we don't promise that it will always be available or free of errors.

12. Limitation of liability

To the extent the law allows:

• Dalalmaf is not liable for any deal, payment, dispute, loss or damage arising between users, or from relying on any listing or message.
• Dalalmaf is not liable for any indirect, incidental or consequential loss, or for loss of profit, data or opportunity.
• Dalalmaf's total liability to you for any claim about the service is limited to the amount you paid Dalalmaf in the 12 months before the claim. If you paid nothing, it is limited to ₹1,000.

Nothing in these Terms limits any liability that cannot be limited under Indian law.

13. Indemnity

You agree to compensate Dalalmaf, its owners and staff for any claim, loss or cost (including reasonable legal fees) caused by your content, your listings, your dealings with other users, or your breach of these Terms or the law.

14. Suspending or closing accounts

We may suspend or close your account, or remove your content, if you break these Terms, the Listing Policy or the law, if another user reports you and we find the report justified, or if we need to protect users or Dalalmaf. Where appropriate, we will tell you why.

You can close your account at any time from Account → Privacy and your data.

15. Complaints and grievances

16. Governing law and disputes

These Terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts at Surat, Gujarat.

17. Changes to these Terms

We may update these Terms from time to time. We will show the new date at the top of this page. If the change is significant, we will tell you on the website or by message before it takes effect. By using Dalalmaf after a change takes effect, you accept the updated Terms.
